Terms & Conditions
Estimate: The price given is a true estimate of what we expect to charge you. If accepted we require a minimum of 25% deposit upfront before work commences. All estimates must be checked and read by the customer before accepting to commence works. If there are circumstances that we could not have been aware of or additional works added to the original estimate then this will affect the original price, we will provide you with an updated estimate if requested. You have the right to accept the price or decline if a further estimate has been requested if not work will proceed and any additional work will be added to the final invoice. Payment will be required for any work completed up to the point you cancel.
Works : In the event of the Customer being unsatisfied with the work completed by Burtons Property Services, the customer agrees to allow Burtons Property Services an opportunity to rectify the said works also known as snagging. Where the Customer refuses or otherwise prevents from rectifying the works, to the full extent permitted by law, the liability of Burtons Property Services to the Customer for the works shall be extinguished and the customer will be liable to Burtons Property Services for payment in full of Burtons Property Services invoices.The Customer expressly acknowledges and agrees that it has not relied upon, and Burtons Property Services is not liable for any advice given by Burtons Property Services, its servants, agents, representatives or employees in relation to the suitability for any purposes of the works The Customer agrees with Burton's Property Services of the date of delivery or completion of the works, give written notice to Burtons Property Services, with particulars of any claim that the works are defective or not in accordance with the agreement between Burtons Property Services and the Customer. In the event that the Customer fails to give such notice within the said period, then to the full extent permitted by law, the works are deemed to have been accepted by the Customer and all claims by the Customer against Burtons Property Services for the works are extinguished and the Customer must pay Burtons Property Services for the works.
Liability : To the full extent permitted by law, all conditions, warranties and representations express or implied by statute, common law or otherwise in relation to the works are hereby excluded, and to the full extent permitted by law, Burtons Property Services will be under no liability to the Customer for any damages (including but not limited to incidental, special, consequential or general damages) in connection with or arising out of the supply or use of the works howsoever arising, even if due to Burtons Property Services negligence, or the negligence of Burtons Property Services servants, agents, sub-contractors or suppliers. These terms and conditions do not affect the rights, entitlements and remedies compulsorily conferred on the Customer under the Trade Practices Act 1974 and other statutes, rules or regulations for the time being in force, and nothing in these conditions shall be read or applied so as to exclude, restrict or modify or have the effect of excluding, restricting or modifying any condition, warranty, guarantee, right or remedy implied by law and which by law cannot be excluded, restricted or modified. In the event that liability cannot be excluded, to the fullest extent permitted by law, Burtons Property Services to the Customer shall be restricted at Burtons Property Services option to a refund of the invoiced amounts paid by the Customer to Burtons Property Services, or replacement of the works.
Payments : Full payment is required on satisfactory completion. In the unlikely event you are dissatisfied you are entitled to withhold an amount to cover any corrective work that may be required. We should be given the opportunity to complete any corrective work. The customer has the right to also withhold no more than 10% of the final invoice price until the snagging list is complete.Unless otherwise agreed in writing the Customer must pay Burton's Property Services invoices for services and goods (collectively known as “the works”) and other charges at the time of the rendering an invoice to the Customer. The Customer must pay the invoices or any money due in full and without deduction, notwithstanding any entitlement that it may have to a credit or offset however arising. Payments can be made in various methods agreed between Burtons Property Services and the customer. A 25% deposit will be taken on all estimates before any works will commence.
Non Payments : Burtons Property Services will retain title to (but not risk in) Goods delivered to the Customer or installed on behalf of the Customer until Burtons Property Services has received payment in full for them and all other sums owing to it by the Customer. Burtons Property Services right to retain title does not affect its rights as unpaid. If the Customer fails to make any payment to Burtons Property Services when due Burtons Property Services is entitled, and the Customer grants Burtons Property Services a license to enter the Customer’s premises and land where the goods are situated with or without notice and to re-take possession of and remove, at the Customer’s cost and expenses, the Goods in respect of which title has not passed to the Customer. Burtons Property Services shall be entitled to use the Customer’s name and to act on the Customer’s behalf in exercising these rights and Burtons Property Services is not liable for any costs, losses, damages or other expenses suffered by the Customer or any third party in respect of Burtons Property Services retaking possession and removing the Goods. The Customer acknowledges that Burtons Property Services is entitled to remove the Goods even if such removal would result in damage to a structure and the Customer acknowledges that Burton's Property Services will not be liable to the Customer for such damage, howsoever arising.
Damages : Burtons Property Services will not be liable for any damage unless caused by our negligence. You should report any damaged or faulty products within a reasonable time. In usual circumstances, we would request that you inspect the goods and report any faults within 48 hours of inspection
Bespoke goods : Unfortunately Burtons Property Services are unable to accept returns for goods made to the consumer’s own specification (bespoke items) unless the goods are faulty or not as described.
Faulty goods: Burtons Property Services will work in line with the Sale of Goods Act, which states that any goods purchased should be as described, of satisfactory quality and fit for the purpose for which they were intended. Your rights vary depending on the nature of the fault and the length of time you have had the goods. If in the unlikely event a problem arises, we aim to resolve the issue within a reasonable time.
Cancellation: The Customer may cancel any work at any point up to 14 days before works have commenced. Cancellation after the 14 day period will incur a 10% cancellation from the deposit. If the Customer decides to cancel whilst works are in progress or before completion then Burtons Property Services will payment from works completed plus a 10% cancellation fee to cover the cost of labour, materials and administration. All cancellations must be made in writing.
Guarantee : All works made by Burtons Property Services are guaranteed for 30 days after works completion . After 30 days have expired and no repairs or snagging has been claimed by the customer then Burtons Property Services will not be liable to return and make adjustments but will charge for any further repairs. Minimum call out charge for work out of guarantee period will be £65.
